Yes, ADUs are legal in Massachusetts. In August 2024, Governor Maura Healey signed the Affordable Homes Act, which, among other provisions, allows for the construction of one ADU up to 900 square feet by right on a property in single-family zoning districts across all Massachusetts communities.
Under the Affordable Homes Act, an ADU can be no larger than 900 square feet or half the size of the principal dwelling's gross floor area, whichever is smaller.
No, the new legislation prohibits municipalities from requiring a special permit or other discretionary zoning approval for the use or rental of an ADU in single-family residential zoning districts.
Municipalities cannot require more than one parking space for an ADU located outside 0.5 miles from a commuter rail station, subway station, ferry terminal, or bus station. For ADUs within 0.5 miles of such transit stations, municipalities cannot require any parking spaces.
